  1. AVAILABILITY AND DELIVERY

The products offered by Fifty are available for delivery exclusively within mainland Spain and the Balearic Islands.

Orders will be processed once payment has been successfully received.

The products offered by Fifty are always subject to availability, which will be specifically indicated on our website for each product. If any item offered is unavailable, the customer will be duly informed. Under normal circumstances, all products shown on our website are available for delivery within the stated timeframes.

If, after an order has been placed, the product purchased by the CUSTOMER is out of stock, the CUSTOMER will be duly informed and offered an alternative product with similar characteristics and of the same price and quality as the product purchased. If the CUSTOMER does not wish to accept the proposed alternative, Fifty will refund the amount already paid and will provide information on the refund procedure and timeframe.

As a general rule, the maximum period for collecting the product in store or for home delivery will be 20 days from the date of purchase and from the time we confirm receipt of payment. These delivery periods are approximate and may vary depending on the destination (outside mainland Spain) or specific dates or seasons (for example, Christmas or sale periods).

Deliveries will be made on business days (Monday to Friday). The CUSTOMER is advised to indicate their preferred delivery times when completing the order details in the Comments section.

If home delivery has been selected, the carrier will deliver the purchased product together with a delivery note to the address stated in the purchase order, which the customer must sign as proof of receipt. The CUSTOMER will also be duly informed if an incident occurs or delivery is delayed for any reason.

If delivery cannot be made to the address provided because the recipient is absent, the carrier will contact the CUSTOMER directly and/or leave a notice to arrange a new delivery, including detailed instructions on the steps to be followed. If delivery is impossible because an incorrect address was provided, the CUSTOMER will bear the cost of reshipping the order.

To ensure that you are kept informed of the processing of your purchase at all times, you will receive an email confirming your order and payment.

The CUSTOMER may also check the status of their order through our website by accessing their customer account.

  1. PAYMENT AND PAYMENT TERMS

The following payment methods are accepted:

– Credit and Debit Card: The transaction is carried out by connecting directly to CaixaBank through its payment gateway.

– PayPal: By connecting directly to PayPal.

– Bank transfer: By paying the full purchase amount into the bank account provided. This payment may only be made through banking institutions established in the European Union.

IMPORTANT: Customer identification for high-value transactions. In accordance with current anti-money laundering regulations (Spanish Law 10/2010 of 28 April), for purchases exceeding EUR 1,000, Fifty Jewel Studio, S.L. may require the customer to provide the documentation necessary to verify their identity and, where applicable, information regarding the source of funds. Failure to provide this information may make it impossible to process or complete the purchase.

Once payment has been made, you will receive an email confirming payment.

Fifty does not have access to your credit card details. All our payment systems are fully secure.

Payment must be made before the product is delivered. Accordingly, Fifty will not supply the requested product until payment has been received. Fifty reserves the right to suspend or permanently discontinue the services provided in the event of any payment-related issue.

  1. INVOICES

You will receive your invoice together with the product at the time of delivery.

The CUSTOMER is responsible for confirming receipt of notifications and for informing us of any changes to their details. Fifty shall be released from any liability arising from a failure to do so.

  1. WARRANTY

The statutory warranty applicable to the sale of consumer goods does not apply to the restoration, repair or alteration of jewellery supplied by the customer, as these are services performed on goods owned by the customer. These services are governed by the specific liability regime described in section “9. LIABILITY FOR THE JEWELS REBORN SERVICE”.

All our products are subject to quality controls and are guaranteed against manufacturing defects for a period of three years from the date of purchase. The warranty covers any manufacturing, design or material defect, provided that the lack of conformity is reported within 10 days of the date on which the CUSTOMER became aware of it. The warranty covers defective products only. It does not cover impacts, misuse or any other damage that is not attributable to a supplier defect or a flaw in the product. During the warranty period, the CUSTOMER may return the product and we will repair or replace it. Any transport costs arising from returns under warranty shall NOT be borne by the CUSTOMER.

The purchase invoice serves as the warranty document

  1. RETURNS

Restoration, repair or alteration services performed on jewellery supplied by the customer are not eligible for return, as they consist of customised work carried out on goods owned by the customer and not the sale of standardised products. These services are governed by the specific liability regime described in section “9. LIABILITY FOR THE JEWELS REBORN SERVICE”.

Products may only be returned or exchanged in the event of a manufacturing defect, damage in transit or a delivery error. In all cases, no more than 14 days may have elapsed since receipt of the product, and the original packaging and accessories must be included. Before accepting the return, we will verify that the issue is a manufacturing or packaging defect or anomaly and not the result of improper or negligent use, handling or storage. The corresponding delivery note or invoice must always be enclosed.

In the event of a return due to a manufacturing or packaging defect, or an error in the order, the CUSTOMER will, where possible, be offered repair of the item or its replacement with an alternative item at no additional cost and without entitlement to any compensation. The cost of shipping the repaired or correct order shall be borne by Fifty.

In all cases, any return shall be subject to Fifty’s prior examination of the condition of the product being returned and verification that the requirements set out in these terms and conditions of sale have been met. Once the return has been received and, where applicable, accepted, we will refund the amount paid within a maximum period of 30 days using the same method originally used for payment.

Fifty reserves the right to reject returns notified or sent outside the specified period, or returns of products that are not in the same condition in which they were received.

Returns shall be arranged by emailing fifty@fiftyjewel.com with a description of the reasons and grounds for the return. The customer’s full name and order reference number must also be provided. Once the request has been received, we will process it accordingly.

  1. RIGHT OF WITHDRAWAL

In accordance with consumer legislation and, in particular, Article 103(c) of Royal Legislative Decree 1/2007 of 16 November, the right of withdrawal does not apply to:

  • restoration, repair or alteration services performed on jewellery supplied by the customer, as these are personalised services carried out in accordance with the customer’s specifications and, where applicable, using materials owned by the customer. These services are governed by the specific liability regime described in section “9. LIABILITY FOR THE JEWELS REBORN SERVICE”; and
  • rings made in a size other than the standard Tatum size 14. For these purposes, customers are expressly informed that Tatum size 14 is the standard size held in stock. Any variation from this size requires the ring to be made in accordance with the customer’s individual preferences and specifications and is therefore considered a personalised product, to which the right of withdrawal does not apply.

For all other products, you have the right to withdraw from this contract within 14 calendar days without giving any reason.

The withdrawal period shall expire 14 calendar days after the day on which you, or a third party indicated by you other than the carrier, acquire physical possession of the goods.

To exercise the right of withdrawal, you must notify Fifty Jewel Studio, S.L., Muntaner 200, 6º 6ª, 08036 Barcelona, email: fifty@fiftyjewel.com, of your decision to withdraw from the contract by means of an unequivocal statement (for example, a letter sent by post, fax or email). You may use the model withdrawal form set out below, although its use is not compulsory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the relevant withdrawal period has expired.

Effects of withdrawal:

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for any supplementary costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event no later than 14 calendar days from the day on which we are informed of your decision to withdraw from this contract. We will make the reimbursement using the same means of payment that you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having returned the goods, whichever occurs first.

You must return the goods to Fifty Jewel Studio, S.L., Muntaner 200, 6º 6ª, 08036 Barcelona, without undue delay and in any event no later than 14 calendar days from the day on which you inform us of your decision to withdraw from the contract. The deadline shall be deemed to have been met if you return the goods before that period has expired.

You shall only be liable for any diminished value of the goods resulting from handling other than that necessary to establish the nature, characteristics and functioning of the goods.

  1. LIABILITY FOR THE “JEWELS REBORN” SERVICE

For restoration, repair or alteration services performed on jewellery supplied by the customer, the company is responsible for the proper performance of the work carried out. In the event of a defect directly attributable to the work performed, the customer may make a claim for a minimum period of three months from delivery of the jewellery.

This liability is limited exclusively to the work performed and does not cover defects arising from prior wear, the original condition or the intrinsic characteristics of the materials supplied by the customer, or from subsequent use. Nor shall the company be liable for pre-existing damage or defects that were duly disclosed or that are inherent in the jewellery’s prior condition.

  1. FORMATION OF THE CONTRACT AND SERVICE MODIFICATIONS

This contract shall become binding upon payment for the product.

Fifty reserves the right to modify the characteristics and conditions of its services in any manner, provided that the purpose is to improve them and that the modification benefits the CUSTOMER.

  1. OBLIGATIONS OF THE PARTIES

Fifty undertakes to provide the CUSTOMER with the products purchased, exercising the utmost diligence in the provision of the service; to maintain the facilities required for the operation of the network, with suitable technical and IT resources; and to manage the logistics, shipment and delivery of purchases through the carrier.

The CUSTOMER undertakes to use the services made available in good faith, without breaching any applicable law or infringing the rights of third parties, to pay for the selected product within the time and in the manner established in these terms and conditions of sale, and to receive it at the stated delivery address.

Fifty does not guarantee that the service covered by this contract will be continuously and uninterruptedly available, due to circumstances arising from Internet network problems, computer equipment failures or other unforeseeable events. The CUSTOMER therefore agrees to tolerate such circumstances within reasonable limits.

  1. COMMUNICATIONS

All notices between the parties shall preferably be sent by email. The CUSTOMER is responsible for confirming receipt of notices and for informing FIFTY of any change to their details, and FIFTY shall be released from any liability arising from a failure to do so. In the event of any change, the CUSTOMER must notify FIFTY using the email address or telephone numbers shown on our website.

In accordance with Article 21 of Spanish Law 34/2002 on Information Society Services and Electronic Commerce, we inform you that our commercial communications and information relating to our website and the products offered on it will be sent by email to the address you provide, and your consent may be withdrawn at any time. The CUSTOMER is fully aware that this contract is accepted and performed by providing their details and clicking the “Buy” button displayed on our website, and that the contract becomes binding upon payment for the service.

  1. APPLICABLE LAW

This contract is commercial in nature and shall be governed by and construed in accordance with Spanish law.

In the event of any dispute or disagreement between the parties concerning the interpretation, content or performance of the Contract that cannot be resolved by mutual agreement, the parties shall submit to the courts of the CUSTOMER’s place of residence, provided that the CUSTOMER is acting as a consumer.

Where the user is resident outside a Member State of the European Union, or where the transaction consists of a purchase or contract entered into by a company or professional, both parties expressly waive any other jurisdiction to which they may be entitled and submit to the Courts of Barcelona, Spain.
